Curio Blvd App — Terms of Service

These Terms govern your use of the Curio Blvd mobile app and the services offered inside it. They are separate from the terms that apply to purchases on curioblvd.com.
The app is operated by Chelsey Brown LLC ("Curio Blvd", "we", "us", "our"). By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use the app.
1. Who can use Curio Blvd You must be at least 13 years old to have an account, and at least the age of majority where you live to buy a membership or a research service. If you are between 13 and the age of majority, you may use the app only with the involvement of a parent or guardian.
2. Your account You are responsible for your account, for keeping your password and any Backup Planner passcode private, and for what happens under your account. Tell us promptly at support@curioblvd.com if you believe someone else has gained access.
Some content in the app is protected by a passcode or Face ID that you set. We cannot recover that passcode for you. If you lose it, the protected content may be permanently inaccessible.
3. Membership and billing Parts of Curio Blvd require a paid membership. Memberships are sold as auto-renewing subscriptions through the Apple App Store.
- Payment is charged to your Apple ID at confirmation of purchase.
- Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
- Your Apple ID is charged for renewal within 24 hours before the end of the current period.
- You manage and cancel your subscription in your Apple ID settings — not in the app. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under the App Store's terms. We generally cannot issue refunds for App Store purchases ourselves.
- We may change prices for future periods. We will tell you before a price change affects you, and you can cancel before it takes effect.
4. Redemption codes Some features are unlocked by a code — supplied with a Curio Blvd product, a research service, or a gift. Codes are for one account, are not redeemable for cash, and may expire or be withdrawn if obtained unfairly.
5. Genealogy research services We separately offer done-for-you family history research. If you buy it, we build a family tree and written history and deliver it into your account by code.
Genealogy is a research service, not a product with a guaranteed result. Records are incomplete, contradictory, and sometimes wrong at the source. We do our best with the records that exist, but we cannot promise a specific ancestor, document, or discovery, and findings may be revised as new records surface. The delivered tree is yours to keep.
6. Your content stays yours Everything you put into Curio Blvd — your recordings, photos, videos, scans, notes, recipes, family tree and planner entries — belongs to you. We do not claim ownership.
You give us only the permission we need to run the service for you: to store, back up, process and display your content, to show it to the people you choose to share it with, and to transmit it to the providers described in our Privacy Policy so a feature you asked for can work. That permission ends when you delete the content or your account, apart from backups that age out on a normal cycle.
We do not use your content to train AI models, and we do not sell it.
7. Content about other people Curio Blvd is built for family history, so much of what you save is about other people — often people who are living.
You are responsible for having the right to upload what you upload. Before you record, upload or share someone else's voice, face, likeness, letters or personal details, make sure you have their permission where permission is needed. Recording a person without consent may be unlawful where you live.
If someone tells us that content in your account is theirs and should not be there, we may contact you, and where we are legally required to, remove it.
8. AI features Some features use artificial intelligence. Using them sends the relevant content to a third-party AI provider for processing — see the Privacy Policy for who they are.
Photo Restore produces an AI-generated interpretation of a damaged or faded photo. It may invent detail that was not in the original. Keep your original — treat the restored image as a new version, not a corrected record.
Recipes in their voice. A recipe can carry a recording of the person whose recipe it is, and that recording does not have to be made in the app — you can upload a voice recording you already have, or the audio from an old video, a voicemail or a home movie. There are two ways it can be used, and you choose which:
- A full recording of the recipe — them reading or telling the whole thing. This is played back exactly as you supplied it. Nothing is generated, and no voice model is made from it.
- A voice sample — a shorter recording used to create a synthetic version of their voice, which then reads that recipe aloud. This is an AI recreation, not the person. It is produced by a third-party voice provider (see the Privacy Policy), and it may mispronounce or misread. It is not evidence of anything they said.
You need the consent of a living person before creating a synthetic version of their voice. Where the app asks you to confirm consent, that confirmation is your representation to us that you have it. Only upload a recording you have the right to use; if someone else is speaking in it, section 7 applies to them as it does to any other content about another person.
Do not use a recreated voice to impersonate anyone, to mislead a person into thinking they are hearing the real individual, or for any legal, financial, medical or identity-verification purpose.
9. Sharing and collaborators You can share parts of your Curio with other people, and give some of them permission to add to it. When you do:
- You control what is shared and can stop sharing at any time. Someone who already saw or saved something may still have it.
- A collaborator's additions are stored in your account and are subject to these Terms.
- Content shared with you belongs to the person who shared it. Do not redistribute it without their permission.
10. The Backup Planner is not professional advice The Backup Planner helps you gather estate and emergency information in one place. It is an organisational tool. It is not legal, financial, tax or medical advice, and nothing in it is a will, trust, power of attorney or other legally binding instrument. Talk to a qualified professional to make your wishes legally effective.
11. Acceptable use Do not use Curio Blvd to break the law; to upload content you have no right to; to harass, impersonate or endanger anyone; to store another person's biometric or identity data without their consent; to attempt to access another account; or to interfere with, probe or overload the service.
12. Availability We work to keep the app running and your content safe, but we do not promise uninterrupted or error-free service. Features may change, and we may add, alter or retire them. If we plan to retire something you rely on, we will give you reasonable notice and, where we can, a way to export your content.
Keep your own copies of anything irreplaceable. Curio Blvd is a place to keep family history — it should not be the only place a precious recording or photograph exists.
13. Ending your account You can stop using the app and request deletion at any time (see the Privacy Policy). We may suspend or close an account that seriously or repeatedly breaks these Terms, or where we must for legal reasons. Where it is reasonable to do so, we will tell you first and give you a chance to export your content.
14. Disclaimers and limits To the extent the law allows, the app is provided "as is" without warranties of any kind, and our total liability to you for any claim relating to the app is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 100. We do not exclude liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud.
Nothing here removes consumer rights you have under the law where you live.
15. Indemnity You agree to cover us for claims and costs arising from content you uploaded that you had no right to upload, or from your misuse of the app, to the extent it results from your actions.
16. Governing law These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws rules, and the courts of New York have jurisdiction — except where the law of your home country gives you the right to bring a claim there.
17. Changes to these Terms We may update these Terms. If a change is significant, we will tell you in the app or by email before it takes effect. Continuing to use the app after that means you accept the updated Terms.
